Terms of use for social media content (user content)

GEDORE GmbH and its companies (collectively referred to as "GEDORE") ask social media users for permission to post certain content published by the respective users on social media (user content) on various GEDORE websites and social media channels. By allowing GEDORE to use certain content (by responding to a request from us or on our behalf on social media or otherwise giving your consent for GEDORE to use your content), you agree to the following terms and conditions. Please read the conditions carefully.
- In these Terms, "Content" refers to photos and / or videos, including audio and accompanying text, posted on social media through your profile, as well as the accompanying metadata such as time and place of creation, your username / profile name and links to your social media profiles. You grant GEDORE the right to use your image, likeness, descriptions, location or other identifying information, including but not limited to your voice, in connection with the use of your User Content.
- You permit GEDORE to use the content worldwide in any media for lawful commercial purposes. The content may be used by GEDORE in original or edited form on GEDORE social media accounts, websites, blogs and social media ads.
- GEDORE is entitled to use, display, reproduce, distribute, transmit, create derivative works from, combine with other materials, modify and / or adapt your User Content as it sees fit and without any further obligations such as acknowledging the source.
- These rights apply to all companies of the GEDORE Group.
- The rights you grant GEDORE in respect of the use of your content are perpetual.
- The rights you grant to GEDORE in respect of the use of your content are non-exclusive.
- GEDORE will not pay any licence fees or compensation to you or third parties for the use of the content. Use of the Content is at GEDORE's discretion and GEDORE is under no obligation to use your Content in any particular way or at all.
- You agree that seeking review or approval to use the content is at GEDORE's discretion and you have no right to review, approve or object to GEDORE's use of the content or to be identified as the author / creator of the content. In principle, however, GEDORE will endeavour to identify you as the author / creator of the content.
- GEDORE respects the applicable laws and rights of third parties and wishes to avoid the use of content that violates such laws and rights. With your consent, you represent to GEDORE that:
- you are the author of the original work and the owner of the content and all intellectual property rights and have all rights to grant GEDORE the rights set out in these terms and conditions, including authorship, trademarks, private and public buildings, performances, sounds and music.
- if you are not the owner of these rights set out, you have already obtained permission from the rights holder and will inform GEDORE immediately if permission to use is withdrawn by the rights holder.
- GEDORE's use of your content in accordance with this agreement does not infringe any intellectual property, privacy, image, performance, personal or publicity rights, or any other rights of third parties, require payment of compensation or licence to third parties, or violate any applicable laws.
- nothing in your content is illegal, defamatory, obscene, offensive, threatening or discriminatory to any third party; and
- you are over 18 years of age and therefore entitled to agree to these Terms of Use.
- You indemnify GEDORE and hold GEDORE harmless from and against all actions, claims, losses and damages arising from third party claims in connection with the use of your content. Including infringement of intellectual property rights, data protection, privacy, image, performance and publicity rights.
- Content published by GEDORE may contain information about you or identifiable individuals that constitutes personal data under applicable law. By agreeing to these terms, you consent to the processing of such personal data by GEDORE, solely for the purposes set out in these terms.
- Where personal data relating to other persons appears in the content, you warrant that you have obtained their consent to the processing of their personal data.
- GEDORE will process personal data contained in your Content or otherwise provided to us in connection with the use of the Content in accordance with all applicable data protection laws and our privacy policy available here.
- If you wish to withdraw consent to the use of your content, or if you believe that any of your user content has been used in violation of your rights or the rights of third parties, please notify GEDORE via
